O fim do mandato vitalício para os ministros do Supremo Tribunal Federal (STF) entrou em debate com a PEC 16/29, proposta pelo senador Plínio Valério (PSDB-AM), a qual estabelece o mandato de oito anos para ministros do STF, sem possibilidade de recondução.
Para Roberto Caldas: “Há muito entendo que é oxigenador que os máximos tribunais de um país sejam compostos por ministros com mandatos, os quais devem ter ao menos nove anos, como na prática internacional. É razoável que, com a mudança da sociedade, que expressa a sua vontade nas urnas e elege seus dirigentes, que estes possam escolher nomes afeitos ao pensamento vencedor.
Hoje um ministro do Supremo pode em tese permanecer por 40 anos no Tribunal, se nomeado aos 35 anos.
Entretanto, a vigência de mudanças estruturais como esta devem se projetar para o mandato do futuro Presidente, de modo a evitar casuísmo e verdadeira cassação dos poderes integrantes das regras do
jogo da última eleição.
Nesta linha, somente os ministros nomeados doravante devem ter mandatos, pois não se deve aplicar aos ministros atuais, que já têm a garantia da
permanência até os 75 anos.”.
