No habeas corpus n.º 783.927/MG, o Superior Tribunal de Justiça decidiu que a prova obtida no processo penal mediante a quebra de sigilo médico é ilícita, de forma a contaminar a ação penal e ocasionar o seu trancamento.
O processo tratava sobre acusação de autoaborto, que chegou ao conhecimento da autoridade policial após ser informada por médico que atendeu a ré e constatou a ingestão de medicamento abortivo. Além disso, ele enviou o prontuário médico da ré e testemunhou no processo, em infração ao art. 207 do Código de Processo Penal.
Ainda, o STJ foi provocado a decidir sobre a inconstitucionalidade do crime de autoaborto. No entanto, considerou que não poderia fazê-lo em controle difuso de constitucionalidade, uma vez que a competência para isso é do Supremo Tribunal Federal e já existe ação pendente sobre o tema — a ADPF n.º 442.
O STJ também determinou que o juízo de 1.º grau encaminhe os autos ao Conselho Regional de Medicina competente e ao Ministério Público local para tomarem as medidas cabíveis quanto à conduta do médico.
