No entanto, considerou que não poderia fazê-lo em controle difuso de constitucionalidade, uma vez que a competência para isso é do Supremo Tribunal Federal e já existe ação pendente sobre o tema — a ADPF n.º 442.
O STJ também determinou que o juízo de 1.º grau encaminhe os autos ao Conselho Regional de Medicina competente e ao Ministério Público local para tomarem as medidas cabíveis quanto à conduta do médico.
